Residential Private Roads General Information
The City of Fishers Department of Engineering recognized the need to establish a policy for the dedication and acceptance of privately owned residential roads within the City of Fishers. All neighborhoods with privately owned residential roads that met criteria requirements adopted by the City of Fishers Board of Public Works and Safety (Ordinance #R031322H) and are eligible for dedication are included within the list below and may be submitted for consideration of City acceptance and permanent responsibility. All eligible private roads within the designated neighborhood must be submitted for acceptance by the HOA/POA or property owners responsible for the private road for applications to be considered. Additionally, approval will be subject to the satisfaction of conditions being met after an onsite assessment by the Department of Engineering.
These conditions include a survey (if necessary) for revisions to parcel lines and payment (for roads that are rated at an 8 or less on the PASER rating scale*) equal to 10% of the engineer’s estimate to mill and resurface the private roads, including necessary curb repairs. If the City of Fishers Board of Public Works and Safety agrees all conditions have been met and approves the acceptance of the privately owned residential road, the City of Fishers will permanently assume all responsibility for the ongoing maintenance and regulation of those roadways. ** (Please see the specific ordinance and conditions below)
* PASER rating Scale (Pavement Surface Evaluation and Rating System) is a 1-10 nationwide rating system for road pavement conditions developed by the University of Wisconsin Transportation Information Center which uses visual inspection to evaluate pavement surface conditions based on surface defects, surface deformation, cracks, and patches and potholes.
** Any landscaped or common areas adjacent to the dedicated road will remain under ownership and responsibility of the HOA/POA or property owners’ responsibility.
Dedication & Acceptance Policy
Overview
The City of Fishers Department of Engineering sees the need to establish a policy for the dedication and acceptance of privately owned residential roads within the City of Fishers.
Scope
All privately owned residential roads which met criteria requirements and were adopted in R031322H by City of Fishers Board of Public Works and Safety are included within the guidelines of this policy.
Policy
The City of Fishers (“City”) will accept dedicated privately owned residential roads within the City of Fishers by way of approval at the Board of Public Works and Safety. The approval will be subject to previous inclusion as a candidate by the Board of Public Works and Safety and satisfaction of conditions being met after onsite assessment by the Department of Engineering.
Procedure/Conditions:
- Neighborhood HOA/Board or property owners responsible for the maintenance of the private road will submit a request for consideration to dedicate their privately owned residential roads.
- Department of Engineering will perform onsite assessment of current condition, PASER rating, and needed maintenance. An engineer’s estimate of needed maintenance will be completed by the Director of Engineering or their designee.
- Survey work must be completed (if necessary) for revisions to parcel lines. The Homeowners Association/Property Owners Association or property owner shall be responsible for the cost of the survey work and establishment of legal description or other revision to parcel lines.
- a payment equal to 10% of Engineer’s estimate to mill and resurface private roads, including needed curb repairs, will be required for dedication/acceptance. This condition would be required for private roads that are rated less than a 9 (nine) on the PASER rating scale.
- No monetary payment will be required for private roads which are rated a 9 or 10 on the PASER rating scale.
Responsibility
If the City of Fishers Board of Public Works and Safety agrees all conditions have been met and approves the acceptance of the privately owned residential roads, the City of Fishers will permanently assume all responsibility for the ongoing maintenance of those roadways. This will include maintenance to the roadway surface, pavement markings, curb, standard signage, and winter maintenance operations. Any landscaped or common area adjacent to the dedicated road will remain under ownership and the responsibility of the Homeowners Association/Property Owners Association. The roads will be subject to all applicable City ordinances including but not limited to speed limits, stop conditions, and parking restrictions.
